WHAT IS SO WRONG WITH OUR CONSTITUTION?

What is so wrong with our constitution that the clamour to have it reviewed is engulfing the whole nation by the day?

You know this constitution is only ten years old and it was billed just the other day as the most significant development to have ever came from this nation on the constitutional making front after very many failed attempts.

The sons and daughters of this nation made it their business to holistically review our constitutional order and brought up what we have today after so much engagement with everyone, including both the experts and the commoners, who ultimately validated the constitution through a referendum and its promulgation happened in a broad day light, meaning it had everyone's blessing, only for us to be confronted with the new needs to have this same constitutions reviewed.

The question no one is asking or to which an answer is not forthcoming is this " what is so wrong with our constitution that we must urgently review it"  because from where i sit i don't find anything wrong with it and i therefore need to be convinced to join the bandwagon because this taking of us for fools by the political class is this nation's biggest undoing and time is now when we must take things by the horn and tell them " you know what, its enough".

Kenya is just an amazing nation, we never cease to surprise.

  2. What people don't understand is that not everything will favor them or go their way. Those who want the constitution reviewed feel that some ACTS or clauses don't favor their interest which is too bad!

    1. You can say this again, constitution cannot be made with few people's interests in mind.

Its for our general wellbeing and those who think they can circumvent this constitutional thing to suit their need are doomed because their effort will die

  3. Some legislators are pushing for the review of constitution for their own self interest.

  4. And reviewing the constitution has to take legal action which is expensive and time consuming.

    1. The issue is actually not the cost implications but the rationale on which the whole clamour is informed.

  6. The problem is that we didn't read the constitution, majority voted for or against it because our leaders said so.
It's now haunting us because we do not know what the contents are

  7. The other day I mentioned that the clamor for the constitutional change has nothing to do with the mwananchi wa kawaida! If today Raila says "our constitution is good, we do not need to change it." Trust me, no one will talk about constitutional changes.

Your question has two categories of answers; elitist answers and populist answers.

From the POPULIST PERSPECTIVE, there is absolutely nothing wrong with the constitution. Those agitating for change simply want to create positions for themselves.

From the ELITIST PERSPECTIVE, this constitution is bad. It does not promote "inclusivity" in government. It is a "winner-takes-it-all" constitution which is bad for our ethnic diversity.

If you ask me; I will say that there is nothing wrong with the constitution. What is wrong is our SYSTEM OF ETHICS. We have WRONG people in RIGHT places doing WRONG things using RIGHT systems and institutions.

Unfortunately, we cannot instill good morals in our body politic through Constitutional Amendments.

  9. For starters, the current constitution was a mistake. Were we ready for it?. No
Was it pratical in Kenya's case?. No
